How we collect, use, share and protect personal data in connection with Axis Pro.

Definitions

“Personal Data” means any information relating to an identified or identifiable natural person.

“Processing” means any operation performed on Personal Data, such as collection, use, storage, disclosure or deletion.

“Axis Pro”, “we / us / our”, “Payments Provider”, “Site”, “User / you / your”,

“Property” and “Guest” have the same meaning given to them in our Terms and Conditions.

1. Scope of this policy

This Privacy Policy describes how we collect, use, share and protect Personal Data in connection with Axis Pro, the hospitality management platform described in our Terms and Conditions. This Policy applies to Users who register for Axis Pro and, where applicable, to Guests whose Personal Data is processed through Axis Pro on behalf of a User. This Policy does not cover the payment processing services provided by the Payments Provider, which are described in the Payments Provider's own privacy policy.

2. Our role: controller and processor

When we process Personal Data of a User, such as account information, billing contacts and usage data, we act as the data controller and determine the purposes and means of that Processing. When we process Personal Data of a Guest on behalf of a User, such as reservation details entered or synchronized through Axis Pro, we act as a data processor (or service provider, as applicable under local law), and the User acts as the data controller responsible for that Guest's Personal Data. If you are a Guest and have a question about how your Personal Data is used, please contact the Property where you made your reservation, who can direct your request to us if needed.

3. Personal data we collect

We collect the following categories of Personal Data.

  • (a) Account and User data. When you register for Axis Pro, we collect your name, email address, phone number, job title, business name and address, tax identification information, and login credentials.
  • (b) Guest data processed on behalf of Users. Through the Property Management System, Channel Manager and Spaces module, we process reservation and stay related data that Users enter or that is synchronized from connected booking channels, which may include a Guest's name, contact information, nationality, identification or passport number where required for check-in or legal compliance, arrival and departure dates, and special requests.
  • (c) Payments related data. When Payments features are used, limited transaction metadata (such as amount, currency and status) may be visible within Axis Pro, but sensitive payment credentials, such as full card numbers, are collected and processed directly by the Payments Provider or other payment providers, not by us.
  • (d) Usage and device data. We automatically collect information about how you access and use Axis Pro, including IP address, browser type, device identifiers, pages viewed, and log data, through cookies and similar technologies described in Section 11.
  • (e) Communications. When you contact us for support or otherwise communicate with us, we collect the content of those communications and related metadata.

4. How we use personal data

We use Personal Data to provide, operate and maintain Axis Pro, including the PMS, Channel Manager, AI Co-Manager and Spaces module; process and synchronize reservations across connected booking channels; enable Payments through the Payments Provider or other providers; create and manage User accounts; provide customer support; send administrative communications, such as notices about changes to these policies or to your account; improve, personalize and develop Axis Pro, including through the AI Co-Manager's automation features; detect, prevent and address fraud, security incidents and technical issues; and comply with our legal obligations.

Where applicable data protection law requires a legal basis, we rely on one or more of the following: performance of a contract with you, such as providing Axis Pro under our Terms and Conditions; our legitimate interests, such as improving and securing Axis Pro, provided those interests are not overridden by your rights; compliance with a legal obligation, such as retaining records required by hospitality or tax regulations; and your consent, where required, such as for certain cookies or marketing communications, which you may withdraw at any time.

6. How we share personal data

We may share Personal Data with service providers and subprocessors who support our operation of Axis Pro, such as hosting, analytics and customer support providers, under contractual obligations of confidentiality and data protection; connected booking channels and online travel agencies, to the extent necessary to synchronize reservations through the Channel Manager; the Payments Provider and other payment providers, to enable Payments features; professional advisors, such as lawyers, auditors and insurers, where necessary; competent authorities, where required by law, regulation, legal process or governmental request; and any successor entity in connection with a merger, acquisition, financing or sale of assets, subject to appropriate safeguards. We do not sell Personal Data.

7. International data transfers

Axis Pro is operated from the United States and Chile, and Personal Data may be transferred to, stored, and processed in countries other than the one in which it was originally collected, including the United States. Where required, we implement appropriate safeguards for such transfers, such as standard contractual clauses or equivalent mechanisms recognized under applicable data protection law.

8. Data retention

We retain Personal Data for as long as necessary to provide Axis Pro, comply with our legal obligations, such as hospitality registration and tax record keeping requirements, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of data and the purpose of Processing. When Personal Data is no longer needed, we delete or anonymize it, or, where immediate deletion is not possible, we securely isolate it until deletion is possible.

9. Security

We implement administrative, technical and organizational measures designed to protect Personal Data against unauthorized access, loss, misuse, alteration or destruction. No system is completely secure, and we cannot guarantee the absolute security of Personal Data.

10. Your privacy rights

Depending on the law applicable to you, you may have the right to access the Personal Data we hold about you; request correction of inaccurate Personal Data; request deletion of your Personal Data; object to or restrict certain Processing; request portability of your Personal Data; and withdraw consent where Processing is based on consent. If you are a Guest, we recommend you first contact the Property where you made your reservation, as they are generally responsible for responding to these requests; we will support them, or you directly, as required by applicable law. To exercise these rights, contact us at legal@axispro.travel. Section 12 describes additional rights that may apply depending on your location.

11. Cookies and similar technologies

We use cookies and similar technologies to operate Axis Pro, remember your preferences, analyze usage, and, where applicable, support marketing efforts. You can control cookies through your browser settings; disabling certain cookies may affect the functionality of Axis Pro.

12. Regional disclosures

If you are located in the European Economic Area or the United Kingdom, you have rights under the General Data Protection Regulation (GDPR), including the right to lodge a complaint with your local data protection authority. If you are located in Brazil, you have rights under the Lei Geral de Proteção de Dados (LGPD), including the right to confirmation of Processing, access, correction, anonymization, portability, deletion, and information about entities with which we have shared your data, and you may contact the Autoridade Nacional de Proteção de Dados (ANPD) with any concerns. If you are located in Chile, the Processing of your Personal Data is subject to Law No. 19,628 on the Protection of Private Life, as amended, and to Law No. 21,719, which will progressively come into force, including the rights of access, rectification, cancellation, opposition and portability recognized under Chilean law. If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the right to know, delete, correct and opt out of certain sharing of your Personal Data. We do not sell or share Personal Data for cross-context behavioral advertising.

13. Children's privacy

Axis Pro is intended for business use by Users who operate hospitality Properties and is not directed to children. We do not knowingly collect Personal Data from children. If you believe a child has provided us with Personal Data, please contact us so we can take appropriate action.

14. Changes to this policy

We may update this Privacy Policy from time to time. Changes take effect once posted on the Site. We will notify you of material changes by email or through a prominent notice on the Site, as described in our Terms and Conditions.
